State Program Approval (SPA)
Keep in mind that many states have SPA from the Environmental Protection Agency (EPA) regulations. In these cases, the state regulations that have already implemented their own operator training programs that meets the minimum requirements of section 9010 of the Solid Waste Disposal Act will not have to change their program and are followed instead of the federal EPA rules. States without SPA must follow the new federal rules.

JMM Global’s Software Engineers and Regulatory Specialists meticulously designed state approved training courses for Class A, B, & C Operators. Each training course has at a minimum federally required material and has been modified to meet state and local requirements. Training courses are continuously revised to meet regulatory amendments.

Record Retention

According to the new 2015 Federal UST Regulations, owners and operators must retain a list of designated operators currently trained at each facility and proof of training or retraining. Documentation may be kept offsite and must be maintained for as long as they are designated for the facility.

Through our Application Portal for Environmental Compliance (APEC) system and the OTP, facilities have the ability to store their operator training certificates in our cloud based system and keep track of when their certificates expire. You will never be out of compliance utilizing our software.

Federal Regulation

The new 2015 UST Federal Regulations require owners and operators to designate at least one individual for A, and B operator classes and all individuals that meet Class C operator definition. Designated Operators (DO) must be trained at a minimum in their defined areas and may need to be retrained if the UST system is not in compliance. This change ensures that all operators across the country, including those in Indian Country and in states without operator training requirements, are trained to prevent releases.
